Welcome to GariFile. These Terms of Service (“Terms”) govern your access to and use of the GariFile website, accounts, workspaces, vehicle-record services, document-management features, dealer/business features and other services made available by GariFile.

By creating an account or using GariFile, you agree to these Terms. If you do not agree, you should not use the service.

GariFile is a private technology platform for organizing and managing vehicle-related information and documents. GariFile is not a government department, RTO, Parivahan, VAHAN, police authority or other government authority.

Eligibility and Account Registration

You must provide accurate information when creating and maintaining a GariFile account.

Depending on the services available, you may register as an:

• Individual;
• Dealer;
• Business;
• Company; or
• other supported account type.

You are responsible for ensuring that the information associated with your account remains accurate and reasonably up to date.

You must not create an account using another person's identity or business information without authorization.

Account Security

You are responsible for maintaining the confidentiality and security of your account credentials.

You must not share your password or OTP with unauthorized persons.

If you believe your account has been compromised, you should change your credentials where possible and notify GariFile promptly.

GariFile may implement security measures including email or mobile verification, OTP verification, session controls, multi-factor authentication, rate limiting and other protective measures.

You must not attempt to bypass these security controls.

Authorized Use of Records

You may upload, create, store or manage only information and documents that you are legally entitled or appropriately authorized to use.

You must not knowingly upload:

• stolen documents;
• unlawfully obtained personal information;
• fraudulent or forged records;
• malicious files;
• documents belonging to another person without appropriate authority;
• content that violates applicable law or another person's rights.

You remain responsible for information and documents you submit to GariFile.

Vehicle Information

Vehicle details, document expiry dates and other information displayed in your workspace depend on information entered by users or received through available integrations.

You are responsible for reviewing important information against original documents or appropriate official sources.

Information displayed by GariFile does not by itself establish:

• legal ownership;
• current registration status;
• document validity;
• insurance validity;
• challan clearance;
• tax clearance;
• RTO approval;
• regulatory compliance.

An expiry reminder does not renew a document.

Documents

GariFile may allow you to upload, organize, generate, download, print and share vehicle-related documents.

You remain responsible for determining whether a document is accurate, complete, current and appropriate for its intended purpose.

GariFile does not guarantee that a document uploaded by a user is genuine, legally valid or accepted by any authority.

Private documents are handled according to the GariFile Privacy Policy and applicable permissions.

Dealer, Business and Company Accounts

Dealer, Business and Company accounts may have access to additional features including vehicle inventory, customers, sellers and buyers, documents, purchase and sale workflows, RC-transfer workflows, expenses, branches, team members, reports and other business tools.

A business account is responsible for:

• information entered by its users;
• managing team access;
• assigning appropriate roles and permissions;
• ensuring its employees and representatives use GariFile lawfully;
• obtaining appropriate authority for customer, seller and buyer information;
• keeping business and transaction records accurate.

The workspace owner or authorized administrator may be able to add or remove users and control their permissions.

Seller, Buyer and Customer Information

Dealers and businesses may enter information relating to sellers, purchasers and customers where necessary for their legitimate business workflows.

The dealer or business is responsible for ensuring that it has appropriate authority or another lawful basis to collect, enter and use such information.

GariFile providing a technical field or feature does not mean that every category of information should automatically be collected.

Users should avoid collecting unnecessary personal or identity information.

Team Members and Permissions

Business workspace administrators are responsible for granting access only to appropriate people.

Do not give employees or other users permissions they do not require.

Actions performed through an authorized account may be associated with that account in activity or audit records.

Removing access does not necessarily delete information that a recipient previously and lawfully downloaded or exported.

Document Templates

GariFile may provide templates for vehicle purchase, sale, delivery, declarations, internal dealer records and vehicle-transfer workflows.

Templates are provided as assistance tools.

Unless GariFile expressly identifies a template as a verified current official document, you should not assume that it is the latest government-prescribed format.

Government forms and requirements may change.

Users are responsible for verifying the current applicable requirements before submitting documents to an authority.

RC Transfer Assistance

GariFile may provide workflows that help organize seller, buyer and vehicle information and generate RC-transfer-related drafts, checklists or documents.

Generating, printing, signing or storing a document in GariFile does not by itself transfer ownership of a vehicle.

It also does not mean that:

• an RTO has received the application;
• an RTO has approved the transfer;
• government records have been updated;
• the transfer is legally complete.

Users must follow the applicable official process and verify current requirements with the relevant authority.

Blank or Incomplete Forms

Users are responsible for ensuring that documents are properly completed before they are signed or submitted.

GariFile does not recommend treating a pre-signed incomplete government form as a completed transfer document.

Where a workflow intentionally leaves information incomplete because a transaction has not yet reached the relevant stage, users must ensure that subsequent completion and use comply with applicable requirements.

Government and RTO Disclaimer

GariFile is not a government portal.

GariFile is not operated by or part of the Ministry of Road Transport and Highways, Parivahan, VAHAN, an RTO, police authority or another government authority unless a specific authorized integration expressly states otherwise.

Use of government names, form numbers or links is for identification or reference and does not imply government endorsement, affiliation or approval.

Users should use official government sources for authoritative information.

Challan and Vehicle Information Services

If GariFile introduces challan, vehicle-information or similar integrations, information may be obtained through an authorized provider or other permitted source.

Such information may be delayed, incomplete or unavailable.

Unless expressly stated otherwise, GariFile does not itself issue, cancel, settle or clear government challans.

Users should verify important information through the relevant official authority.

Reminders and Notifications

GariFile may provide reminders for insurance, PUC, RC-related records, documents, tasks or other vehicle events.

Reminders are convenience features.

Failure to receive a notification does not remove the user's responsibility to monitor applicable dates and obligations.

GariFile does not guarantee that every notification will be delivered at a particular time because delivery may depend on devices, internet connectivity and external communication providers.

Payments and Subscriptions

GariFile may offer free and paid plans.

Where paid services are introduced, applicable pricing, billing period, taxes, renewal terms and available cancellation or refund conditions should be shown before purchase.

Payments may be processed through independent payment providers.

Additional payment-provider terms may apply.

GariFile should not store complete card or banking credentials unless specifically necessary and handled in accordance with applicable requirements.

Future and Planned Features

Features marked Coming Soon, Planned, Beta, Preview or similar are not guaranteed to be generally available.

GariFile may change, postpone or discontinue planned features.

Do not rely on a planned feature as though it were an active service.

Acceptable Use

You must not use GariFile to:

• violate applicable law;
• impersonate another person;
• commit or facilitate fraud;
• create or distribute forged documents;
• gain unauthorized access to another account;
• bypass permissions or security controls;
• probe or attack GariFile systems without authorization;
• introduce malware or harmful code;
• scrape or extract information through unauthorized automated methods;
• interfere with service availability;
• misuse another person's personal information;
• use GariFile for unlawful, deceptive or abusive activities.

Security Testing

You must not perform penetration testing, vulnerability exploitation, automated security scanning or similar testing against GariFile infrastructure without prior authorization.

Good-faith security reports should be sent through a security contact made available by GariFile.

User Content and Ownership

You retain your rights in information and documents that you lawfully upload to GariFile.

You grant GariFile the limited permission necessary to host, store, process, display, transmit, back up and otherwise handle that content to provide, secure and maintain the service according to these Terms and the Privacy Policy.

This permission does not transfer ownership of your private vehicle documents to GariFile.

Privacy

Use of personal information through GariFile is also governed by the GariFile Privacy Policy.

The Privacy Policy explains how personal information may be collected, processed, accessed, shared, protected, retained and deleted.

Dealer and business users are responsible for complying with applicable requirements when they enter personal information relating to their customers, sellers, buyers or employees.

India's DPDP Act establishes a framework governing digital personal data, and the notified DPDP Rules 2025 have a phased enforcement timetable.

Electronic Records and Communications

By using an online service, certain actions, notices and agreements may occur electronically where permitted by applicable law.

The Information Technology Act, 2000 recognizes electronic records and provides that contracts should not be denied validity solely because electronic records were used in their formation. (MeitY)

This does not mean that every GariFile-generated document automatically satisfies every statutory requirement for a particular transaction.

Third-Party Services

GariFile may depend on third parties for services such as:

• hosting;
• email;
• communications;
• payments;
• security;
• storage and backups;
• vehicle-information services;
• government or authorized APIs.

Third-party services may be governed by their own terms and privacy policies.

GariFile is not responsible for an independent third party's systems, availability or content except to the extent responsibility cannot lawfully be excluded.

External Links

GariFile may contain links to government or third-party websites.

Providing a link does not automatically mean GariFile controls, operates or endorses that website.

You should review the relevant third party's terms and policies before using its service.

Service Availability

We aim to keep GariFile reliable, but uninterrupted or error-free availability cannot be guaranteed.

Service may occasionally be interrupted because of:

• maintenance;
• upgrades;
• technical failures;
• security incidents;
• internet or infrastructure problems;
• third-party service outages;
• events beyond reasonable control.

Where practical, GariFile may provide notice of significant planned maintenance.

Changes to Features

GariFile may add, modify or discontinue features as the service develops.

Where a change materially affects a paid service or users' rights, appropriate notice will be provided where required.

Suspension and Restriction

GariFile may restrict or suspend an account where reasonably necessary because of:

• suspected fraud;
• serious security risk;
• unauthorized access;
• material violation of these Terms;
• unlawful activity;
• abuse of the platform;
• valid legal requirements;
• non-payment of applicable charges.

Where appropriate and legally permitted, we may provide notice or an opportunity to resolve the issue.

Account Closure

You may request closure of your account through available account controls or by contacting GariFile.

Account closure and deletion of information are subject to the GariFile Privacy Policy and applicable retention requirements.

Business administrators should consider exporting records they are legally required to retain before closing a workspace.

Intellectual Property

The GariFile name, branding, software, website design and original platform materials may be protected by applicable intellectual-property laws.

These Terms do not transfer GariFile's intellectual-property rights to users.

You may not copy, reproduce, sell, reverse engineer or commercially exploit protected GariFile software or branding except where permitted by law or written authorization.

This does not affect ownership of documents and information that you lawfully upload.

No Professional or Legal Advice

GariFile provides technology and information-management tools.

Content, reminders, templates, checklists and generated documents provided through GariFile are not a substitute for professional legal, tax, insurance, financial or regulatory advice.

Where a transaction has legal consequences, you should obtain appropriate professional or official guidance where necessary.

Accuracy of Information

We aim to provide reliable functionality, but information may originate from users or independent sources.

GariFile does not guarantee that every piece of information displayed through the service is complete, current or error-free.

Users should verify critical vehicle, legal, payment and government information before relying on it.

Disclaimer of Warranties

To the extent permitted by applicable law, GariFile is provided on an “as available” basis.

Nothing in these Terms excludes warranties, guarantees or other rights that cannot lawfully be excluded.

GariFile does not guarantee that the service will always be uninterrupted, error-free or suitable for every user's specific legal or business requirement.

Limitation of Liability

To the extent permitted by applicable law, GariFile will not be responsible for indirect or consequential loss arising solely from reliance on incorrect user-entered information, failure to verify government requirements, unauthorized sharing by a user, third-party outages or misuse of the service.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

Indemnity

To the extent permitted by applicable law, you are responsible for claims or losses resulting from your unlawful use of GariFile, fraudulent documents, violation of another person's rights or material breach of these Terms.

This provision does not remove responsibilities that applicable law places on GariFile.

Changes to These Terms

GariFile may update these Terms when:

• services change;
• new features are introduced;
• security requirements change;
• business practices change;
• applicable laws or regulations change.

The latest version and effective date will be displayed on this page.

Where required by applicable law, material changes will be communicated through an appropriate notice or acceptance mechanism.

Governing Law

These Terms are governed by the laws of India, subject to any mandatory rights, jurisdiction or remedies available under applicable law.

Nothing in these Terms prevents a user from exercising rights or remedies that cannot lawfully be waived or restricted.
